CHANGES TO THE RIGHT-TO-WORK PROCESS

1. Please refer to the pre-application questions on a candidate’s application card (Harri Hire) and check what details haven been filled out in response to the following questions:

a) Are you eligible to work in the UK?

b) What Right-to-work document do you hold? - compulsory

c) If you hold an EU, EEA or Swiss document, please provide your share code to confirm your eligibility to work in the UK below (9 digits only).


2. As per normal, it is at the Right-to-Work request stage of the Recruitment Swimlanes, that a pending new starter must upload their documentation to send to Trust ID.

Here, you will need to attain the person’s:

  • Date of Birth and;

  • Retrieve their 9-digit Share Code from the pre-app. questions or the Right to Work stage (if provided).

You will use this data to carry out a right-to-work check through the Right-to-Work service website and confirm– https://right-to-work.service.gov.uk/view/share-code

*If the check confirms either Settlement or Pre-Settlement Status, you must download the document to a PDF and store on the Drive > Validation Share Code Reports

From the Home Office – UK Employment Legislation

From 1 July 2021, the process for completing right-to-work checks on EU, EEA, and Swiss citizens will change. Employers will no longer be able to accept EU passports or ID cards as valid proof of right-to-work, with the exception of Irish citizens.

What are right to work checks?

Employers must check that all job applicants have the right to work in the UK before employing them, to avoid being liable for a civil penalty.

There are 2 types of right-to-work check: A manual check and an online check. The type of check you need to conduct depends on the status of the individual you are employing, and in some circumstances, the individual’s preference. 

1. An online right-to-work check is required for individuals who only hold digital proof of their immigration status in the UK. This includes most EU, EEA, and Swiss citizens. To carry out an online right to work check, you will need the applicant’s date of birth and their share code, which they will have obtained online. You can then complete the check online by visiting GOV.UK/view-right-to-work.

2. A manual check can be completed for UK and Irish nationals who can use their passport as proof of right-to-work. Employers will also need to complete a manual check for individuals in the UK who do not hold a digital immigration status.

You must carry out a right-to-work check for every individual you employ. Employers can face a civil penalty of up to £20,000 for each illegally employed worker who does not have the right to work in the UK and where correct checks were not undertaken.
